TariffPilot Platform Service-Description

1. Leistungsbeschreibung des TariffPilot

a. Der TariffPilot unterstützt den Kunden bei der Einreihung von Waren in den Zolltarif. Der TariffPilot erstellt auf Basis einer Warenbeschreibung (inkl. der benötigten Informationen zum Material, zur Beschaffenheit, der Funktion und besonderer Merkmale) einen Einreihungsvorschlag auf Basis des Europäischen Zolltarifs.

b. Die Einreihungsvorschläge werden inkl. eines Memos („PilotMemo“) im TariffPilot dargestellt. Für die inhaltliche und fachliche Richtigkeit kann die TariffPilot GmbH keine Gewähr übernehmen. Die finale Prüfung sowie die damit einhergehende Freigabe selbst obliegt dem Kunden (vgl. dazu Ziffer 2.2 der Allgemeinen Geschäftsbedingungen (AGB) für die Nutzung des Onlinetools „TariffPilot“). Die TariffPilot GmbH selbst kann und darf keine Steuer- oder Rechtsberatung leisten.

c. Der TariffPilot bietet die Möglichkeit einer ergänzenden Web-Recherche zur Identifikation von Produktmerkmalen (soweit öffentlich einsehbar).

d. Entsprechend Ziffer 2.3 Abs. 1 der Allgemeinen Geschäftsbedingungen (AGB) für die Nutzung des Onlinetools „TariffPilot“ ist der TariffPilot am vereinbarten Bereitstellungszeitpunkt gemäß dem Vertrag betriebsfähig bereitgestellt, wenn der Zugang eingerichtet und möglich ist und die TariffPilot GmbH dem Kunden die Freischaltung mitgeteilt hat. Es kommt nicht darauf an, wann der Kunde den ersten Zugriff vornimmt.

2. Speicherplatz

Dem Kunden wird im Rahmen der Nutzung des TariffPilot Speicherplatz für seine Inhalte und die durch die Nutzung des Programms generierten Inhalte zur Verfügung gestellt. Die Gesamtdatenkapazität der im Rahmen der Nutzung vom TariffPilot hochgeladenen Dokumente darf insgesamt 500 MB nicht überschreiten. Ein einzelnes hochgeladenes Dokument darf die Größe von 20 MB nicht überschreiten. Sollte mehr Speicherplatz benötigt werden, ist dies unter den Vertragsparteien abzustimmen.

3. Systemvoraussetzungen

Zur Nutzung des TariffPilot sind nachfolgende Systemvoraussetzungen seitens des Kunden erforderlich, für deren Anschaffung und Erhaltung der Kunde verantwortlich ist:

a. Der TariffPilot ist eine reine Web-Anwendung und erfordert als solches keine Installation auf den Rechnern des Kunden. Für den Zugriff wird ein moderner Rechner mit installiertem Browser folgenden Typs vorausgesetzt:

  • Google Chrome (aktuelle Version)
  • Mozilla Firefox (aktuelle Version)
  • Apple Safari (aktuelle Version)
  • Microsoft Edge

b. Die Script-Sprache JavaScript muss in jedem Fall aktiviert sein. Ferner müssen Cookies zugelassen werden.

c. Die Nutzung anderer bzw. älterer Browser(-versionen) kann zu Fehldarstellungen und Fehlfunktionen führen. Hierfür wird seitens der TariffPilot GmbH kein Support und darüber hinaus auch keine Gewähr für etwaige Richtigkeit und keinerlei Haftung übernommen. Schadensersatzansprüche sowie etwaige Kürzungen der Kosten/Gebühren seitens des Kunden sind in einem solchen Fall ausgeschlossen.

d. Weiterhin wird am Client für die Anzeige vom System generierter Daten vorausgesetzt:

  • Adobe Acrobat Reader (oder kompatibel, aktuelle Version)
  • oder Microsoft Excel (2010/2013/2016/365) / OpenOffice (aktuelle Version) für XLSX/CSV-Formate

e. Für den Zugang zum TariffPilot benötigt der Kunde ferner einen Internet-Anschluss über einen Internet-Provider seiner Wahl. Hierfür evtl. zusätzlich erforderliche Hard- und Softwareprodukte sind vom Kunden auf seine Kosten zu beschaffen wie auch zu installieren und sind von diesem Vertrag nicht umfasst.

f. Ebenso sind anfallende Kommunikationskosten sowie evtl. Nutzungsgebühren des Internet-Anschlusses vom Kunden zu tragen.

g. Für die Beschaffenheit der erforderlichen Hard- und Software auf Seiten des Kunden sowie für die Telekommunikationsverbindung zwischen dem Kunden und der TariffPilot GmbH bis zum Übergabepunkt ist die TariffPilot GmbH nicht verantwortlich.

1. TariffPilot service description

a. TariffPilot supports the customer in classifying goods in the customs tariff. Based on a description of the goods (including the required information on the material, composition, function and special features), the TariffPilot creates a classification proposal based on the European Customs Tariff.

b. The classification proposals are displayed in TariffPilot including a memo ("PilotMemo"). TariffPilot GmbH cannot accept any liability for the correctness of the content and technical accuracy. The final check and the associated validation is the sole responsibility of the customer (see section 2.2 of the General Terms and Conditions (GTC) for the use of the "TariffPilot" online tool). TariffPilot GmbH itself cannot and may not provide any tax or legal advice.

c. TariffPilot offers the option of a supplementary web search to identify product features (where publicly available).

d. In accordance with Section 2.3 (1) of the General Terms and Conditions (GTC) for the use of the "TariffPilot" online tool, TariffPilot is ready for operation on the agreed provision date in accordance with the contract if access is set up and possible and TariffPilot GmbH has notified the customer of the activation. It does not matter when the customer performs the first access.

2. Storage space

When using TariffPilot, the customer is provided with storage space for their content and the content generated by using the program. The total data capacity of the documents uploaded as part of the use of TariffPilot may not exceed a total of 500 MB. A single uploaded document may not exceed 20 MB in size. If more storage space is required, this must be agreed between the contracting parties.

3. System requirements

In order to use TariffPilot, the following system requirements must be met by the customer, who is responsible for acquiring and maintaining them:

a. The TariffPilot is a pure web application and as such does not require any installation on the customer's computer. A modern computer with the following type of browser installed is required for access:

  • Google Chrome (current version)
  • Mozilla Firefox (current version)
  • Apple Safari (current version)
  • Microsoft Edge

b. The script language JavaScript must be activated in any case. Cookies must also be enabled.

c. The use of other or older browsers (versions) can lead to incorrect displays and malfunctions. TariffPilot GmbH does not provide any support for this, nor does it guarantee any accuracy or accept any liability. Claims for damages and any reductions in costs/fees on the part of the customer are excluded in such a case.

d. Furthermore, the following is required on the client for displaying system-generated data:

  • Adobe Acrobat Reader (or compatible, current version)
  • or Microsoft Excel (2010/2013/2016/365) / OpenOffice (current version) for XLSX/CSV formats

e. To access TariffPilot, the customer also requires an Internet connection via an Internet provider of his choice. Any additional hardware and software products required for this are to be procured and installed by the customer at his own expense and are not covered by this contract.

f. Any communication costs incurred and any usage fees for the Internet connection shall also be borne by the customer.

g. TariffPilot GmbH is not responsible for the quality of the necessary hardware and software on the part of the customer or for the telecommunications connection between the customer and TariffPilot GmbH up to the transfer point.
